General terms and conditions of business and delivery

 

The following conditions apply to all orders of products from the Benediktiner Weissbräu online shop. The contractual partner, service provider and user of these terms and conditions is:

The company Stuco Fullservice GmbH – Benediktiner Weissbräu shop, Industriestrasse 17, 54662 Speicher – assumes all processing for orders, including payment transactions, on behalf of Bitburger Braugruppe GmbH. Stuco Fullservice GmbH operates on behalf of Bitburger Braugruppe GmbH.

 

1. Conclusion of contract for orders in the Benediktiner Weissbräu online shop

You will be provided with an order summary of the products you selected using the ‘Add to shopping basket’ button prior to conclusion of the order. In this order summary, you can review all information you entered during the ordering process and complete and/or correct it as needed using the ‘Edit’ option. By clicking on ‘Place order now’, you submit your order information and make a binding declaration to Bitburger that you want to acquire the products listed there (offer). 

After your order is submitted, you will receive an automatically generated email with which Bitburger confirms receipt of your order (order placement confirmation). The individual details of your order are provided once more in this confirmation email. The text of your order is stored by Bitburger and can be sent to you upon request after conclusion of your order. For secure documentation, Bitburger recommends printing out the order information as well as the general terms and conditions applicable at the time the order was placed. 

The order placement confirmation does not represent acceptance of your offer and does not constitute a contract. A contract does not come into being until Bitburger expressly declares its acceptance of your offer (order acceptance confirmation) or your offer is accepted by shipment of the goods you ordered (without prior express declaration of acceptance). Bitburger is entitled to decline an offer made by you without reason, in particular in the event of violations of clause 7 of these general terms and conditions. German is available as the contract language.

 

2. Prices, shipping costs, conditions of delivery

The prices specified in the online shop are final prices including value added tax. Shipping costs are not included in the price of the order and are added to it. Shipping costs amount to:

Within Germany: €5,50
To other countries: €8,90

Shipping within Germany is free of charge for orders of €50 or more. For payment with cash on delivery, an additional surcharge of €8.05 is added regardless of the amount of the order. Cash on delivery is not possible for deliveries to other countries. Any potential import taxes and customs duties for orders placed outside Germany are determined based on the respective regulations of the country of import and are invoiced separately to the customer.

Shipping costs for personalised labels amount to €0.80; if they are ordered in combination with other items from the Bitburger shop, the shipping costs are added to the standard shipping costs specified above.

Delivery times are between four and five working days from the date the order is placed for payment by cash on delivery, one to five working days for payment in advance and one to five working days for all other payment methods. Delivery times to other countries are between one and 40 days from the date the order is placed. 

 

3. Retention of title

The goods delivered remain property of Bitburger Braugruppe GmbH until payment has been made in full.

 

4. Payment conditions

In our online shop, you can pay using the following methods:
• Cash on delivery (only for orders within Germany)
• Payment in advance
• PayPal

For payments made by cash on delivery, an additional surcharge of €8.05 is added.

For payments made via PayPal, you will be automatically redirected to the PayPal website after placing your order. The payment process is then determined by the provisions of PayPal.

For payments by cash on delivery, you make your payment directly to the delivery service when they deliver your goods. In this case, please have the corresponding amount available in cash.  

For payments in advance, the account information will be provided to you in your order placement confirmation; delivery will be initiated once payment has been received.

 

5. Statutory right to withdraw and withdrawal form template

Right to withdraw, exclusion of right to withdraw

You have the right to withdraw from this contract within 14 days without indicating any reason.

The withdrawal period is 14 days from the day on which you, or a third party specified by you who is not the carrier, take possession of the goods, if you have ordered one or more items as part of a single order and the goods are delivered as a whole

or

on which you, or a third party specified by you who is not the carrier, take possession of the goods, if you have ordered several items as part of a single order and the goods are delivered separately.

In order to exercise your right to withdraw, you must inform us – Bitburger Braugruppe GmbH, Römermauer 3, 54634 Bitburg, phone: +49 (0)6561 143 365, fax: +49 (0)6561 143 369, email: shop@bitburger.de – about your intention to withdraw from this contract by means of a clear declaration (e.g. a letter sent by post, fax or email). To do so, you can use the withdrawal form template attached; this is, however, not a requirement.

In order to maintain the withdrawal period, it is sufficient if you send notification of your intent to exercise the right to withdraw prior to expiration of the withdrawal period.

The right to withdraw in accordance with point 5 is excluded for the delivery of goods which have been produced according to your specifications and customised to your personal needs, or which are not suitable for return due to their characteristics.

 

Consequences of withdrawal

If you withdraw from this contract, we are to return to you all payments we have received from you, including delivery costs (with the exception of the additional costs that result from you choosing a method of delivery other than the standard delivery method offered by us), immediately and at the latest within 14 days of the date on which we receive notification of your intent to withdraw from this contract. For this return of payment, we use the same payment method which you used for the original transaction, unless otherwise expressly agreed with you; under no circumstances will you be assessed fees for this refund. We may withhold return of payment until we have received the goods in return or until you have proven that you have sent the goods back, whichever occurs first.

You must return the goods to Stuco Fullservice GmbH, Industriestrasse 17, 54662 Speicher, Germany, immediately and at the latest within 14 days of the date on which you inform us of your withdrawal from this contract. The deadline will have been met as long as you send the goods before the end of the 14-day period.

We bear the costs for returning the goods.

6. Warranty

The statutory warranty rights apply to all goods, unless other agreements have expressly been made. In the event of complaints, please contact our service provider Stuco Fullservice GmbH.

Some items also come with an independent manufacturer’s warranty, so be sure to keep the invoice and, if applicable, the warranty card from the manufacturer and/or the delivery slip. Please contact the relevant manufacturer directly in the event of a warranty claim. Your statutory warranty rights are not limited by this manufacturer’s warranty. 

 

7. Personal data

Protecting your personal data is important to us. For detailed information about the scope and purpose of our data usage, please refer to our  data protection declaration.

 

8. Choice of law, jurisdiction

The contractual relationship is subject to the law of the Federal Republic of Germany to the exclusion of the regulations of the UN Convention on Contracts for International Sales of Goods. Place of jurisdiction is Bitburg, Germany, provided the customer is a merchant, legal person under public law or a special fund under public law.

 

9. Dispute resolution

(Information according to Article 14, paragraph 2, of the EU Regulation on consumer ODR and section 36 of the German Act on Alternative Dispute Resolution in Consumer Matters [VSBG])

The European Commission provides a platform for online dispute resolution (ODR), which you can find at http://ec.europa.eu/consumers/odr/ We are neither obligated nor prepared to take part in a dispute resolution process before a consumer arbitration board.
